Why of all the western nations do we the citizens of Australia

 

have no Bill of Rights?

What are our politicians afraid of?

 

Free speech

 Every citizen should have the infallible right to free speech (With the exception of a citizen's right to slander or preach hatred., vilify) and Parliament shall make

no law prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition

the Government for a redress of grievances.

Freedom to travel

Every citizen should have the right to travel unimpeded by laws or bureaucracy on non freehold land with in the commonwealth

or overseas

 

Freedom of belief

All people have the right to believe and practice their beliefs as long as it does not infringe on the rights of another to exercise the same freedom and Parliament shall

make no law respecting an establishment of religion nor what constitutes a legitimate belief.

But no believer or religion may have the right to consider their beliefs above the power of the law of The Commonwealth of Australia

Freedom of association

All people have the right to congregate and form and organise associations, trade unions etc; a right that should be made unassailable by any law.

Right to vote

The right of citizens of the The Commonwealth of Australia to vote shall not be denied or abridged by The Commonwealth of Australia or by any State on account of sex, age, race or beliefs.

The right of the people to be secure in their persons

, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants issued without showing probable cause, supported by the most stringent of guidelines, and particularly describing the place to be searched, and the persons or things to be searched for

The right for justice and a fair trial

  All people should have the right to face their accuser and know of what they are being accused.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a public danger; nor shall any person be subject for the same offence to be twice t in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.  In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favour, and to have the Assistance of Counsel for his defense. The Judicial power of the The Commonwealth of Australia shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the The Commonwealth of Australia by Citizens of another State, or by Citizens or Subjects of any Foreign State The Commonwealth of Australia shall not be construed to condemn or aid and abet in the condemnation of one of it's citizens and must do all within it's powers of diplomacy and laws to protect it's citizens from unjust incarceration (i.e. David Hicks) Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the Commonwealth of Australia, or any place subject to their jurisdiction.
Parliament shall have power to enforce this article by appropriate legislation.
All persons born or naturalized in the Commonwealth of Australia, and subject to the jurisdiction thereof, are citizens of the Commonwealth of Australia and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the Commonwealth of Australia; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. The right to demand honesty from politicians This needs a lot of work and suggestions from those much wiser than me but not of politicians or lawyers whose sole aim seems to be to make things anything but simple. So let us all think about it and suggest and see what humane ideas we can aspire to
